    책 소개

    밤 열한 시, 텅 빈 사무실에 혼자 남아 모니터를 노려보던 기억이 아직도 선 명합니다.

    그때는 사이버수사라는 말조차 낯설던 시절이었습니다. 경찰서에 접수되 는 인터넷 사기, 명예훼손, 계정 도용, 어설픈 해킹 사건이 오로지 컴퓨터 좀 만 질 줄 안다라는 이유 하나로 제 책상 위에 쌓였습니다. 참고할 매뉴얼도, 물어 볼 선배도 없었습니다. IP 주소 하나를 확인하려고 공문을 보내 놓고 며칠을 기 다렸고, PC방 로그를 한 줄씩 눈으로 훑다가 새벽을 맞았습니다. 어렵게 특정한 피의자의 주소지로 달려가 보면 이미 흔적은 사라진 뒤였고, 그런 날이면 혼자 애꿎은 자판을 두드리며 이게 대체 수사가 맞긴 한가하고 투덜대곤 했습니다.

    그런데 그렇게 겨우 해결한 사건의 피해자가 조사실을 나서며 늦은 시간 정말 고맙습니다.”라고 건넨 짧은 인사 한마디가, 그 모든 밤을 견디게 했습니 다. 이 책은 바로 그 시절에서 출발합니다.

    이후 24년 동안 저는 경찰 실무 현장에서 사이버 범죄 수사를 담당했습니다. 불모지에서 시작한 수사는 디지털포렌식이라는 증거 수집과 입증의 새로운 방식 으로 자리 잡았고, 범죄는 상상하지 못한 속도로 진화했습니다. 그 시간 동안 제 가 배운 것은 두 가지였습니다. 하나는 현장에서 통하지 않는 이론은 공허하다는 것이고, 다른 하나는 이론의 뒷받침이 없는 수사는 법정에서 무너진다는 것입니다. 그래서 이 교재는 실무에서 정말로 필요한 절차와 판단의 요령을 담되, 그 근거가 되는 법령과 판례, 학문적 논의를 결코 소홀히 하지 않았습니다. 압수·수색의 적 법절차와 증거능력에 관한 부분에 특히 공을 들인 것도 같은 이유에서입니다.

    경찰 생활을 마감하고 대학으로 자리를 옮긴 지 어느덧 7년이 지났습니다. 그 시간은 제게 또 다른 배움의 기간이었습니다. 강의실에서, 연구실에서, 때로 는 학교 앞 식당에서 학생들과 어울리며 저는 학생들이 진정으로 궁금해하는 사이버 범죄 수사가 무엇인지를 알게 되었습니다. 학생들이 원한 것은 화려한 기술 용어의 나열이 아니라, “그래서 실제로는 어떻게 하는가?”에 대한 답이었 습니다. 이 책의 구성과 서술 방식, 곳곳에 배치한 사례와 질문들은 모두 그 7 년의 대화에서 나온 것입니다.

    부디 이 책이 사이버 범죄 수사를 처음 접하는 학생에게는 친절한 안내서가 되고, 현장의 실무자에게는 곁에 두고 확인하는 참고서가 되기를 바랍니다.

    머리말

     

    밤 열한 시, 텅 빈 사무실에 혼자 남아 모니터를 노려보던 기억이 아직도 선 명합니다.

    그때는 사이버수사라는 말조차 낯설던 시절이었습니다. 경찰서에 접수되 는 인터넷 사기, 명예훼손, 계정 도용, 어설픈 해킹 사건이 오로지 컴퓨터 좀 만 질 줄 안다라는 이유 하나로 제 책상 위에 쌓였습니다. 참고할 매뉴얼도, 물어 볼 선배도 없었습니다. IP 주소 하나를 확인하려고 공문을 보내 놓고 며칠을 기 다렸고, PC방 로그를 한 줄씩 눈으로 훑다가 새벽을 맞았습니다. 어렵게 특정한 피의자의 주소지로 달려가 보면 이미 흔적은 사라진 뒤였고, 그런 날이면 혼자 애꿎은 자판을 두드리며 이게 대체 수사가 맞긴 한가하고 투덜대곤 했습니다.

    그런데 그렇게 겨우 해결한 사건의 피해자가 조사실을 나서며 늦은 시간 정말 고맙습니다.”라고 건넨 짧은 인사 한마디가, 그 모든 밤을 견디게 했습니 다. 이 책은 바로 그 시절에서 출발합니다.

    이후 24년 동안 저는 경찰 실무 현장에서 사이버 범죄 수사를 담당했습니다. 불모지에서 시작한 수사는 디지털포렌식이라는 증거 수집과 입증의 새로운 방식 으로 자리 잡았고, 범죄는 상상하지 못한 속도로 진화했습니다. 그 시간 동안 제 가 배운 것은 두 가지였습니다. 하나는 현장에서 통하지 않는 이론은 공허하다는 것이고, 다른 하나는 이론의 뒷받침이 없는 수사는 법정에서 무너진다는 것입니다. 그래서 이 교재는 실무에서 정말로 필요한 절차와 판단의 요령을 담되, 그 근거가 되는 법령과 판례, 학문적 논의를 결코 소홀히 하지 않았습니다. 압수·수색의 적 법절차와 증거능력에 관한 부분에 특히 공을 들인 것도 같은 이유에서입니다.

    경찰 생활을 마감하고 대학으로 자리를 옮긴 지 어느덧 7년이 지났습니다. 그 시간은 제게 또 다른 배움의 기간이었습니다. 강의실에서, 연구실에서, 때로 는 학교 앞 식당에서 학생들과 어울리며 저는 학생들이 진정으로 궁금해하는 사이버 범죄 수사가 무엇인지를 알게 되었습니다. 학생들이 원한 것은 화려한 기술 용어의 나열이 아니라, “그래서 실제로는 어떻게 하는가?”에 대한 답이었 습니다. 이 책의 구성과 서술 방식, 곳곳에 배치한 사례와 질문들은 모두 그 7 년의 대화에서 나온 것입니다.

    부디 이 책이 사이버 범죄 수사를 처음 접하는 학생에게는 친절한 안내서가 되고, 현장의 실무자에게는 곁에 두고 확인하는 참고서가 되기를 바랍니다.

    이 원고를 마무리한 연구실은 경산시 하양읍 가마실길에 있습니다. 옛 이름 부호리(釜湖里)에서 온 길 이름으로, 마을 뒷산이 가마솥을 엎어 놓은 형상이라 하여 가마실이라 불렸고 그것을 한자 부()로 옮긴 것이니, 애초에 이 땅은 가마솥이라는 이름을 지고 있었던 셈입니다. 그 이름이 예언이 되었는지, 올여 름 하양의 낮 기온은 39.9도까지 올라 전국에서 가장 뜨거운 곳이 되었고 급기 야 경산에는 사상 처음으로 불볕더위 중대 경보까지 내려졌습니다. 방학이라는 말이 무색하게, 이름 그대로 가마솥이 된 이 여름을 땀으로 견디며 한 장 한 장 눌러쓴 원고가 이렇게 한 권의 책이 되었습니다.
